1. About these terms
- These terms apply when you buy a website from Webty. Webty is the trading name of Jamie Davies, a sole trader, of 43 Derlwyn, Dunvant, Swansea SA2 7QA. You can contact us at info@webty.co.uk.
- "We" and "us" means Webty. "You" means the business buying from us.
- Business customers only. By placing an order you confirm you are buying for your business, including as a sole trader, and not as a consumer.
- Each website you buy is a separate website plan with its own monthly subscription. These terms apply to each plan separately.
- Your contract is made up of these terms, the Licence terms, the Data processing terms and the details of your order. Our Privacy policy explains how we use personal data.
2. What you get
- A website built from the webkit ("kit") you choose, with the pages, features and colour palettes shown on its kit page and live demo.
- Set-up: we build your site from the content you give us, give you one round of corrections, connect your domain and publish it.
- While subscribed: hosting, an SSL certificate, backups, kit updates, your dashboard for editing your content, and messages to our team. We aim to reply within 2 working days.
- No custom development. We don't add pages, features, layouts or design changes that aren't part of your kit. If it isn't in the demo, it isn't in the build.
- Kits are shared designs. Other businesses may use the same kit. Your content, photos and colour choice make your site your own.
- Kit updates. We improve kits from time to time and every site runs the latest version. We'll email you about any change you'd notice on your site.
3. Your account
- You need a Webty account with a verified email address to buy and manage websites.
- Keep your login details safe. You're responsible for what happens in your account, so tell us straight away if you think someone else has used it.
- You can delete your account once none of your websites is active (live, paused, being built or being set up).
4. Prices and VAT
| Item | Price |
|---|---|
| Set-up, per website | £149 one-off |
| Subscription, per website | £29 a month |
| Priority 48-hour launch (optional) | £99 one-off |
| Paused website | £5 a month while paused |
| Local copy when you leave | £199 one-off |
| Archiving during the minimum term | The remaining months of the minimum term at £29 a month |
- VAT. Our prices exclude VAT. We are not currently registered for VAT, so we don't charge it. If we register, we'll add VAT at the rate that applies to charges made from our registration date onwards, and we'll give you at least 30 days' notice by email.
- Offers. Any discount or offer code applies only to the items and period shown at checkout. One discount applies per order.
- Price changes. We may change our prices for future billing periods by giving you at least 30 days' notice by email. Changes never affect what you've already paid.
5. Ordering and paying
- You order on our review page and pay on Stripe's secure payment page. Stripe is our payment provider.
- At checkout you pay the set-up fee, your first month and, if you choose it, Priority launch. Your contract starts when your payment succeeds and we confirm your order by email.
- Your subscription then renews every month on the same date as your checkout and is charged automatically to your card.
- Stripe holds your card and billing details. Billing addresses must be in the United Kingdom. Stripe emails your receipts. Each website's page in your dashboard has a Billing and invoices link where you can see its invoices and update its card.
- We may decline an order, for example if it doesn't meet these terms, and refund anything you've paid in full.
6. Your 14-day refund
- If you change your mind within 14 days of checkout, tell us and we'll refund everything you paid at checkout: the set-up fee, your first month and any Priority launch fee. That website plan then ends.
- The 14 days count from the date of checkout. They don't move if your preview arrives later.
- After 14 days, the rules in sections 8 and 9 apply. Any other refund is at our discretion.
7. Building your website
- Onboarding. Your dashboard asks for your business details, content and photos. Every field comes with example text for your sector, which you can edit or keep.
- Timing. We aim to have your preview ready within 5 working days of receiving all your content. This is a target, not a guarantee, and missing content is the most common cause of delay.
- Priority 48-hour launch. We'll have your preview ready within 48 hours of receiving all your content, counting Monday to Friday and excluding UK bank holidays. If we miss this, we'll refund the £99.
- Corrections. You can send one round of corrections before launch, all in one go, within your kit's built-in options.
- Going live. When you approve your preview, we connect your domain and publish your site. You keep ownership of your domain and stay responsible for renewing it with your domain provider. We'll give you the settings to change.
- Before go-live. Your subscription is charged monthly from checkout while your site is being set up and built.
8. Minimum term and ending a website plan
- Minimum term. Each website has a minimum term of 3 months from the date it first goes live. Months spent paused don't count towards it, so they extend it. After the minimum term, your plan rolls on monthly.
- Before go-live. After the 14-day refund period, you can end a plan at any time before your site goes live. It ends at the end of the month you've paid for. The set-up fee isn't refunded.
- After the minimum term. You can archive your website at any time. Billing stops at the end of the month you've paid for.
- During the minimum term. If you archive your website before the minimum term ends, we charge the remaining months of the minimum term (at £29 a month) before the site goes offline.
- Archived websites are taken offline. You can restore one within 90 days, which restarts its subscription. After 90 days it is permanently deleted, so take a local copy first if you want one.
9. Pausing a website
- You can pause a live website at any time, including during the minimum term.
- While paused, your site shows a holding page and costs £5 a month instead of £29. Paused months extend your minimum term.
- You can resume at any time from your dashboard.
10. If a payment fails
- If a monthly payment fails, Stripe retries it and we email you. You have 14 days to update your card.
- If the payment still hasn't succeeded after 14 days, we automatically pause your website until it's paid.
11. Leaving with a local copy
- You can ask for a local copy of a live, paused or archived website. It costs £199, paid up front.
- Once we approve your request, we prepare your site as files you can host anywhere, and email you a download link that works for 14 days.
- What you may do with a local copy is set out in the Licence terms.
12. Your content and responsibilities
- You own your content. You give us permission to use it to build, host, display, back up and support your website, for as long as we provide the service and for any backup period after.
- You confirm that you have the right to use everything you send us, including text, photos and logos, and that it is accurate, lawful and not misleading. That includes any accreditation or regulator logo you're entitled to display.
- Your legal information. Your kit includes privacy and cookie pages generated from the details you give us. You're responsible for checking they're right for your business, and for meeting any rules that apply to your trade.
- Not allowed: content that is illegal, infringes anyone's rights, is hateful, sexually explicit or misleading, or anything that spreads malware or spam.
- We may remove content or pause a website that breaks the law or these terms. Where we can, we'll tell you why first.
- Webty's small footer credit stays on your site while you're subscribed.
13. Our responsibilities
- We'll provide the service with reasonable skill and care.
- We use reasonable efforts to keep your website available, but we can't promise it will never be interrupted, for example during maintenance or a problem with one of our providers.
- We take regular backups and protect your data as described in the Data processing terms and our Privacy policy.
- Services run by others, such as Stripe, your domain provider, Google Maps and booking tools, are outside our control.
14. Liability
- Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law doesn't allow us to limit.
- We're not liable for loss of profits, revenue, business or goodwill, or for any indirect loss.
- Our total liability for each website plan is limited to the fees you paid for that website in the 12 months before the event that led to the claim.
- You're responsible for claims made by others about the content you supply.
15. Data protection
- Our Privacy policy explains how we use your personal data.
- When your website collects personal data from your customers, for example through its forms, we handle it on your behalf. Our Data processing terms apply to that and form part of these terms.
16. When we can end or suspend a plan
- We may suspend or end a website plan if you seriously break these terms, including not paying after the 14-day grace period, or if your business becomes insolvent. Where reasonable, we'll warn you first and give you time to put things right.
- If we ever stop offering the Webty service, we'll give you at least 90 days' notice and a free local copy of each live website.
17. Changes to these terms
- We may update these terms. We'll email you at least 30 days before a change takes effect for your existing plans.
- If a change is to your disadvantage, you can end the affected plans before it takes effect without any early-archive charge.
- Each version is numbered and dated, and earlier versions stay available on our website.
18. General
- Notices. We'll contact you by email at your account address or in your dashboard. You can contact us at info@webty.co.uk.
- Transfers. We may transfer our rights and obligations under these terms to another business, including a limited company set up to run Webty. We'll tell you if we do. You may not transfer yours without our agreement.
- Whole agreement. These terms and the documents they mention are the whole agreement between us about your website plans.
- If part doesn't apply. If a court decides part of these terms can't be enforced, the rest still applies.
- No third-party rights. Nobody else has rights under these terms.
- Law. These terms are governed by the law of England and Wales, and the courts of England and Wales deal with any dispute.
Data processing terms
Part of the Terms of sale · Version 0.1
Your website may collect personal data about your customers, for example when someone sends an enquiry or a quote request with photos. For that data, you are the controller (you decide why it's collected and what happens to it) and Webty is your processor (we handle it only to run your website for you). UK data protection law requires a written contract between us covering this. These terms are that contract, and they form part of our Terms of sale.
1. What we process
| Item | Details |
|---|---|
| Subject matter | Hosting your website and handling the personal data it collects or displays |
| Duration | While your website plan is active, plus the deletion periods in section 8 |
| Nature and purpose | Storing, displaying, backing up and transmitting data so your website and its forms work, and sending you form submissions by email and in your dashboard |
| Types of personal data | Names, contact details, messages, photos and other details people send through your website's forms; names and photos of people you include on your site, such as staff; basic technical data such as IP addresses in security and error logs |
| People concerned | Visitors to your website, your customers and enquirers, and people named or pictured in your content |
2. Your instructions
- We process this data only to provide your website, as set out in the Terms of sale and as you direct through your dashboard and messages to us.
- If the law requires us to do something else with it, we'll tell you first unless the law forbids that.
- If we think an instruction breaks data protection law, we'll tell you.
3. Confidentiality
Everyone at Webty who can access this data is bound to keep it confidential and accesses it only when needed to provide or support your website.
4. Security
We protect the data with measures suited to the risk, including:
- encryption in transit (HTTPS) and encrypted storage at our hosting providers
- strict separation between customers' data, enforced in the database
- two-step sign-in for all Webty staff, and access only for staff who need it
- regular backups, and security and error monitoring
- keeping our software and providers up to date
5. Our sub-processors
You agree that we may use these providers to run your website. Each is bound by data protection terms at least as protective as these.
| Provider | What they do | Where data is held |
|---|---|---|
| Vercel Inc. | Hosting and serving websites | Functions in London; content served from a global network |
| Supabase Inc. | Database and file storage | London (UK) |
| Resend Inc. | Sending form-submission emails | Sending in Ireland (EU); email logs in the United States |
| Functional Software Inc. (Sentry) | Error monitoring |
- We'll give you at least 30 days' notice by email before adding or replacing a sub-processor. If you object on reasonable data protection grounds and we can't resolve it, you can end the affected website plans without any early-archive charge.
- Where a provider holds data outside the UK, we rely on the safeguards UK law requires, such as the UK–US data bridge or UK international data transfer agreements.
6. Helping you
- If someone asks to see, correct or delete their data, we'll help you respond. That includes finding, exporting or deleting a person's form submissions on your request.
- We'll help you meet your other obligations where they relate to our service, such as security, breach notification and data protection impact assessments.
7. Data breaches
If we become aware of a personal data breach affecting your website's data, we'll tell you without undue delay, and aim to do so within 48 hours, with the information we have and what we're doing about it.
8. When your plan ends
- When you archive a website, its data is kept for 90 days in case you restore it, then permanently deleted, along with its form submissions and uploads.
- Copies in our backups are deleted as those backups expire on their normal schedule.
- Before deletion you can ask us for your form submissions or take a local copy of your site.
- We keep only what the law requires us to keep, such as billing records, which don't contain your customers' data.
9. Checks
We'll give you the information you reasonably need to show that we meet these terms. If that isn't enough, you may arrange an audit with reasonable notice, no more than once a year, at your own cost, in a way that protects other customers' data.
